Ryan, you raise a valid point - I think the biggest potential liability for lawyers engaging social media revolves around client confidentiality.
A lawyer's duties to his or her client remain intact regardless of the medium a lawyer chooses to communicate in. For many of these tools, (a message sent via twitter for example) is equivalent to publishing it on your website - it is a form of broadcast/publication. As such, lawyers must be mindful at all times before hitting send/reply/post etc on any communication. But really, that is no different then the obligation to take similar care before hitting send on a group email, speaking to a colleague in a crowded restaurant or elevator, etc. So I don't see social media as being unique in this regard. However, the importance of a lawyer's duty of confidentiality is something that deserves to be underscored again in the context of these emerging tools.

Thank you for sharing these resources. As an attorney, I'm slowly beginning my social media endeavors but am trying to err on the side of caution. I've stumbled across various articles regarding activities within social media sites that may lead to attorneys being disbarred. It's likely those individuals were approaching the medium incorrectly, but it does pose some questions.
I must disclose that I have not entirely yet read through your presentation slides regarding social media, but what are your thoughts?
